📝 How to Submit a DMCA Takedown Notice

If you are a copyright owner or an agent thereof and believe that any content accessible through the Kevin Stream Service infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our designated Copyright Agent with the following information in writing:

Required Information for a Valid DMCA Notice:

  • Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered, a representative list of such works.
  • Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate the material (e.g., URL, channel name, or specific description).
  • Your contact information, including address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Your physical or electronic signature (typing your full legal name constitutes an electronic signature).

Please send your complete DMCA notice to our designated Copyright Agent using the contact information below. Notices that do not substantially comply with these requirements may not be processed.

↩️ Counter-Notice Procedure

If you believe that content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice to our Copyright Agent. To be effective, a counter-notice must be a written communication that includes:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, for any judicial district in which Kevin Stream may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Upon receipt of a valid counter-notice, we will forward it to the party who submitted the original DMCA notice. If that party does not notify us within 10 business days that they have filed a court action to restrain the allegedly infringing activity, we may restore the material.

🔄 Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Kevin Stream has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We may also limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

A "repeat infringer" is a user who has been notified of infringing activity more than once and/or has had content removed from the Service more than once due to copyright infringement claims.
